If you create an individual account for personal or family use, you confirm that you are 18 years of age or older. If you create profiles for children under 18, you represent and warrant that:

• You are the parent or legal guardian of those children
• You consent to the collection and use of their information as described in our Privacy Policy
• You will supervise their use of the Service
• You accept full responsibility for all activity under child profiles you create

2.3 Educators, Course Creators and Institutions

Course creators and educators must be at least 18 years old to create courses and AI tutors. Students accessing educator-created courses must have appropriate consent from course creators or educational institutions.

3. Service Description

3.1 Individual Subscription

Our individual subscription provides access to AI-powered tutoring across multiple exams and certifications. The Service includes:

• Access to all available AI tutor bundles for exams such as the GCSE
• Multiple member profiles per account
• Personalized learning progress tracking per profile
• Exam preparation materials and practice questions

3.2 Educator Platform

ExpertMinds provides AI-powered educational technology that enables course creators, educators and institutions to transform their course materials into interactive AI tutors. The Service includes course management, AI tutor creation, student enrollment, and conversation analytics.

3.3 AI-Generated Responses Disclaimer

The responses generated by AI tutors are created by artificial intelligence. Users acknowledge that:

• AI-generated responses may contain errors or inaccuracies
• The accuracy of AI tutors depends on the quality of training data and specifications
• AI tutors should supplement, not replace, professional educational guidance or qualified teachers
• Users should verify important information with authoritative sources

4. User Accounts and Subscriptions

4.1 Individual Accounts

• Individual subscribers can create multiple member profiles
• All subscriptions include a 14-day free trial with no credit card required
• Monthly message credit limits apply based on subscription plan
• The account holder is responsible for all activity under their account and any profiles they create
• Access to new tutor bundles might be included at no additional cost as they become available

4.2 Educator Accounts

• Educators and Course creators must register and select a subscription plan (Starter, Growth, Scale, or Institution)
• All plans include a 14-day free trial with no credit card required
• Workspace, student, and content limits apply based on selected plan

4.3 Student Access

• Students access AI tutors via invitation, passcode, or open enrollment
• Student access duration is determined by course creators (1-12 months)
• Students must comply with course-specific guidelines set by creators

5. Payment Terms

5.1 Subscription Billing

Subscriptions are billed monthly or annually. Payment is processed through Stripe and accepts all major payment methods. By providing payment information, you authorize us to charge your payment method on a recurring basis.

5.2 Free Trial

• All new subscriptions include a 14-day free trial period
• No credit card is required to start your trial
• To continue after your trial, you must add a payment method before the trial expires
• If no payment method is added, access will be suspended when the trial ends

5.3 Price Changes

We reserve the right to change our pricing at any time.

5.4 Refunds and Cancellations

• Subscriptions can be cancelled at any time
• Access continues until the end of the current billing period
• No refunds for partial months, unused message credits, or unused features

6. Message Credits and Usage Limits

6.1 Message Credits

• Message credits are shared across all profiles in your account
• Credits reset monthly on at the beginning of each month
• Unused credits do not roll over to the next month
• When credits are exhausted, you will need to purchase more credits or wait until the next billing cycle or upgrade your plan
• Each message sent to an AI tutor consumes 1 credit

6.2 Fair Use Policy

We reserve the right to limit or suspend access to accounts that exhibit excessive or abusive usage patterns, including attempts to circumvent message limits, automated queries, or commercial use of individual accounts.

7. Content and Intellectual Property

7.1 Our Content

All content provided by ExpertMinds, including AI tutor responses, learning materials, lesson structures, and interface elements, are owned by or licensed to TinyHive Labs Limited and are protected by copyright, trademark, and other intellectual property laws.

7.2 User-Generated Content

• Questions and messages sent to AI tutors remain your property
• We may use anonymized conversation data to improve our Service

7.3 Educator Content

Educators retain full ownership of all content uploaded to ExpertMinds, including:

• PDFs, documents, and text materials
• Videos and multimedia content
• Custom prompts and teaching configurations

7.4 AI Processing and Storage

• Content is processed to create embeddings for AI retrieval
• Processed content is securely stored in our databases
• Content remains private to your workspace/account unless explicitly shared

7.5 Conversation Data

ExpertMinds may use anonymized conversation data to:

• Generate insights and analytics
• Improve AI tutor performance and accuracy
• Identify knowledge gaps and learning patterns

8. Prohibited Activities

Users are prohibited from:

• Creating multiple accounts to bypass usage limits
• Using the Service for any illegal, harmful, or fraudulent purpose
• Attempting to extract, scrape, or reverse engineer our AI models or content
• Using automated systems or bots to interact with AI tutors
• Harassing, threatening, or impersonating others
• Uploading or sharing content that infringes on intellectual property rights
• Attempting to access other users' accounts, profiles, or data
• Using the Service for commercial purposes on an individual subscription
• Interfering with or disrupting the Service or its servers

9. Parental Responsibility

If you create profiles for children under 18:

• You are responsible for supervising their use of the Service
• You should review their conversation history periodically
• You should ensure they use the Service appropriately and in accordance with these Terms
• You are responsible for all activity under profiles you create
• You should teach children not to share personal information with AI tutors

10. Data Privacy and Security

10.1 Data Protection

• All data is encrypted in transit and at rest
• Profile data is isolated with access controls
• We comply with GDPR, CCPA, COPPA, and other applicable privacy regulations

10.2 AI Provider Integration

ExpertMinds uses OpenAI, Anthropic, Google and other AI providers to power tutors. Content processed by these providers is subject to their respective terms and privacy policies.

11. Service Modifications and Availability

11.1 Service Updates

We reserve the right to:

• Add, modify, or remove features
• Add new AI tutor bundles and subjects
• Update pricing
• Perform scheduled or emergency maintenance
• Update AI models and algorithms to improve performance
• Modify message credit allocations

11.2 Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11.3 Account Suspension and Termination

We may suspend or terminate accounts for:

• Violations of these Terms
• Fraudulent or abusive behavior
• Non-payment after trial expiration
• Legal requirements or court orders
• Extended periods of inactivity

12. Educational Use Disclaimer

ExpertMinds is designed to supplement formal education, not replace it. Users acknowledge that:

• AI tutors are tools to support learning and should not be the sole source of education
• Students should verify AI responses with textbooks, teachers, and official resources
• AI tutors cannot guarantee exam success or specific grades
• Proper study habits, attendance, and engagement with qualified teachers remain essential

13. Limitation of Liability

To the maximum extent permitted by law, TinyHive Labs Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Inaccuracies in AI-generated responses or educational content
• Academic performance, exam results, or grades
• Service interruptions, downtime, or data loss
• Unauthorized access to accounts despite security measures
• Third-party AI provider limitations, errors, or changes
• Reliance on AI-generated content for important decisions

14. Indemnification

You agree to indemnify and hold harmless TinyHive Labs Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
